BASIC FUNCTION: Under the general supervision of the Public Employment Relations Board’s (PERB) General Counsel, the incumbent will represent PERB in actions and proceedings in the state and federal courts, as assigned.
WORK PERFORMED:
The incumbent will represent the agency, including the Board, in NYS court actions. This includes CPLR Article 78 special proceedings in various jurisdictions and venues. May also initiate court proceedings on behalf of the Board, including applications for injunctive relief, and enforcement and contempt proceedings.
- Assist the New York State Attorney General in its representation of PERB in federal court.
- Confer and correspond with outside agencies and/or representatives on questions of law and procedure.
- Conduct or assist in investigation of charges of illegal employee strikes against public employers and prosecute those charges which are warranted.
- Reviews applications for injunctive relief filed under CSL 209-a.4 and, where appropriate, makes applications to the court for such relief.
- Perform legal research, create internal reports, draft motions, answer briefs and present oral arguments as directed.
- Participate in appearances, including conferences, hearings, and arguments, in-person and/or remotely as the courts require.
- May respond to Freedom of Information Law requests and general inquiries.
- Travel as needed.
- Monitor local government procedures under CSL 212 on a regular basis and bring such proceedings as may be necessary to ensure compliance. Also advise local government officers about PERB’s rules, regulations and policies.
- Initiate such proceedings and take such other steps as are necessary to enforce the orders of the Board.
- Prepare and disseminate legal interpretation of statutes, rules, regulations and decisions for the Board, state agencies, local units of government, employee organizations and other interested parties.
- May assist Deputy Chair in drafting or analyzing legislation, memoranda or Board decisions.
- Other duties as assigned
Minimum Qualifications:
Deputy Counsel: Admission to the New York State Bar and a member in good standing, with a minimum of six (6) years of subsequent, specialized experience in the field of labor-management law and labor-management relations primarily under the Taylor Law or similar collective bargaining laws.
Associate Counsel: Admission to the New York State Bar and a member in good standing with a minimum of four (4) years of subsequent specialized experience in the field of labor-management law and labor-management relations primarily under the Taylor Law or similar collective bargaining laws.
PERB will consider candidates with appropriate post-bar experience and bar admission in a state with reciprocity with NYS. Candidates with bar admission in another state must obtain NYS bar admission prior to their hire date. SALARY RANGE:
Deputy Counsel: $127,507 - $160,911 (M5 Eq)
Associate Counsel: $115,283 – $145,682 (M3 Eq)
Starting salary will be dependent upon specialized experience.
